Mental Capacity Act 2005 (Commencement No 2) Order 2007

This statutory instrument brings into force on 1st October 2007 many sections of the Mental Capacity Act 2005. These include:
- sections 9-14 and Schedule 1, which create the lasting power of attorney, replacing the enduring power of attorney;
- sections 24-26, concerning advance decisions to refuse medical treatment;
- section 45, which establishes a superior court of record to be known as the Court of Protection;
- sections 57 and 58, which create the Public Guardian; and
- section 63 and Schedule 3, which provides conflict of laws rules in relation to persons who cannot protect their own interests
