Cohabitation: The Financial Consequences of Relationship Breakdown (LC307)

The Law Commission has reported on the consequences of breakdown of cohabitation.  They have devised a scheme for eligible cohabiting couples that separate.  They recommend that a remedy should be available where:

  • the couple satisfies certain eligibility requirements: cohabitants who have had a child together or who have lived together for a specified number of years (likely to be between 2 and 5)
  • the couple have not agreed to disapply the scheme; and
  • the cohabitant seeking relief made qualifying contributions to the relationship, giving rise to certain enduring consequences at the point of separation.

The relief would be very different from that available on a divorce.
