Non-Contentious Probate Fees (Amendment) Order 2007

This order inserts Schedule 1A to SI 2004/3120 and describes the circumstances in which someone is entitled to remission or part remission of a fee. The applicant will automatically be entitled if he is receiving a prescribed means-tested benefit or shows that his gross household income is below an amount that would entitle him to such a benefit. Alternatively, after considering their income and outgoings, an assessment will be made and the applicant might need to pay a contribution.
