17th September 2007

Judge Bond; Bournemouth County Court; 2nd August 2007

Husband and wife held a property jointly.  On their divorce, by a consent order the husband’s interest in the property was transferred to his wife.  It was subsequently discovered that he was insolvent and he was declared bankrupt.  His trustee in bankruptcy succeeded in having the transfer set aside as a transaction at an undervalue, within section 339 of the Insolvency Act 1986.
