Gregson v HAE Trustees Ltd
9th May 2008
[2008] All ER (D) 105 (May); [2008] EWHC 1006 (Ch); 8 May 2008; Chancery Division; Robert Miles QC
This was a so-called “dog-leg” claim.
The claimant was a beneficiary of a discretionary trust. He claimed that directors of the trustee company were liable to the trustee company for breach of their duty of care to it and that this liability was trust property. The claim was struck out on the basis that such a claim had no real prospect of success and there were no reasonable grounds for asserting it.
